The Line That Decides the Acreage

Article XII section 1 sets the homestead of a person not within any city or town at not more than 160 acres, and within a city or town at one acre.

On a quarter-acre lot in Broken Arrow that distinction never comes up. On a five-acre parcel outside Owasso, or land annexed into a town during a growth spurt, it decides how much of the property carries the protection. The framework is on our page covering the homestead and its exceptions.

How Would I Know Which Side I Am On?

The county assessor's parcel record names the jurisdiction, and that is the fact to work from rather than the postal address. Annexation around this metro has been active for decades, so land that was county when somebody bought it may sit inside a municipality now. Where a parcel is larger than an acre and the answer is not obvious, an Oklahoma lawyer can settle it quickly and it is worth settling before a decision rather than during one.

Larger Parcels Change the Question

Where a homestead is capped at one acre and the parcel is five, the excess is a different thing from the protected portion, and how that plays out is a legal question rather than an arithmetic one.

For most owners it is academic. For somebody with land, outbuildings or a second structure, it is worth understanding before treating the whole holding as one protected asset.

Does the Fire Change Any of That?

Not the acreage rules, and it changes what is at stake. A fire produces a repair obligation, and work and material used in constructing improvements is one of the three exceptions to the homestead protection. On a larger holding with more structures, the sums involved are larger and the question of which part of the property carries the protection becomes correspondingly more worth answering.

Different Cities, Different Building Departments

Broken Arrow, Owasso, Jenks, Bixby, Sand Springs, Sapulpa, Glenpool and Collinsville are separately incorporated with their own permitting. The county records hold the parcel data across all of them.

So the homestead question is a state one, the parcel question is a county one, and the rebuild is your own city's. Establishing which city holds the property is the first step for the third of those.

Later Construction Decides the Repair

Much of the suburban stock uses engineered roof trusses and floor systems, which come out whole once heat has compromised the connections rather than being repaired in sections. An engineer settles which you have and it decides whether the property is in the repair market or the rebuild market.

Where a house sits on a slab, heat damage to it is invisible from above and becomes the largest unknown on the file, which buyers price by discounting.

Values Usually Favour Repairing

Across much of the suburban ring finished values carry the cost of repair comfortably, so an owner doing the work or a rehabber will beat any cash offer including ours. We would rather say so at the start than negotiate toward a figure that was never going to be competitive.

The Sections That Set the Limits

Article XII section 1 of the Oklahoma Constitution sets the homestead at not more than 160 acres outside a city or town and 1 acre within one, with no dollar cap on value.

The 3 exceptions are purchase money, taxes due and work and material for improvements. Title 31 sections 1, 2 and 3 carry it into the statutes; Laws 1997, chapter 104 amended the article.
