Where a house has passed within a family, the fire arrives on top of an ownership picture that was never fully resolved. Oklahoma's homestead protections carry into probate proceedings, reflecting a long-standing policy of preserving the family home.
Where there is a surviving spouse, that spouse typically has the right to occupy the homestead for life unless it is abandoned. What About Adult Children?
The Protection Does Not Cover Everything
The homestead is generally exempt from most unsecured creditor claims during probate, and the protection does not eliminate consensual liens or tax obligations.
So a mortgage remains a mortgage and property taxes remain due. What the protection holds off is the ordinary unsecured claim, and that distinction matters most on files where several kinds of debt have accumulated.

Older Framing Helps the Arithmetic

The Provisions Behind an Oklahoma Homestead File
Article XII of the Oklahoma Constitution, sections 1 and 2, protects the homestead from forced sale, with 3 exceptions: purchase money, taxes, and work and material for improvements. There is no dollar cap.
The limits are 1 acre inside a city or town and 160 acres outside one. Title 31 sections 1, 2 and 3 carry it into the statutes, and section 1 of Article XII was amended by Laws 1997, chapter 104.
