Out Here the Rural Limit Is the Real One

Article XII sets the homestead of a person not within any city or town at not more than 160 acres. Across Rogers, Wagoner, Creek, Okmulgee and Washington counties that is the applicable figure for a great many properties.

It is a generous limit and it means that on most rural holdings the whole of the homestead is comfortably within it. The framework is on our page covering the homestead and its exceptions.

Does That Change What I Should Do?

It removes a question rather than adding one. Where an urban owner with a large parcel has to think about the one acre limit, a rural owner usually does not. What remains is the same as anywhere in the state: the three exceptions, the spousal consent requirement on a sale, and the fact that the protection attaches to the homestead rather than to the money a sale produces.

Distance Is the Practical Constraint

Contractors price travel and are frequently unwilling to take a residential job far from their base at all. That produces long waits, and a fire-damaged building waiting is a building deteriorating.

It also widens the spread of offers on the same property considerably, because buyers who have visited price accurately and buyers who have not guess in one direction or the other.

Should I Wait for a Tulsa Contractor?

Frequently they will not come, and where they will, travel is priced in. That is not a reason to accept poor terms locally. The Sections That Do Not Change By County

Article XII of the Oklahoma Constitution applies statewide: 160 acres outside a city or town, 1 acre within one, no dollar cap, and 3 exceptions being purchase money, taxes and work and material for improvements.

Title 31 sections 1, 2 and 3 carry the protection into the statutes, and Laws 1997, chapter 104 amended section 1 of the article effective 1 November 1997.
